Zendesk is looking for a well-rounded litigation attorney with intellectual property expertise who is interested in joining its dynamic legal team. You will have the opportunity for lots of ownership in continuing to build the company's litigation practice while delivering practical advice to time-sensitive general litigation, patent, trademark, open source, and copyright related legal matters.

What you get to do every day:

Expand Zendesk's Litigation Practice
  • Manage all aspects of existing and new general and intellectual property litigation and adversarial matters, including managing domestic and foreign external counsel, drafting and reviewing documentation, coordinating internal discovery, and managing productions
  • Work closely with outside counsel in formulating strategy, drafting pleadings, briefs, and managing discovery, including e-discovery
  • Develop and implement scalable and best practices solutions to litigation management, including building an internal discovery and retention practice
  • Educate members of internal partner teams regarding litigation, contract interpretation, privilege, and dispute management best practices
  • Draft and negotiate settlement agreements
  • Manage non-litigation and pre-litigation enforcement matters and disputes related to a variety of potential matters, widely ranging from commercial disputes to other corporate matters - with an emphasis on providing practical solutions
  • Occasional management or participation in collections actions, including but not limited to, insolvency and/or bankruptcy proceedings in jurisdictions worldwide


Manage Patent, Trademark, Copyright and Open Source Programs
  • Manage and implement improvement to internal policies for open source licensing of Zendesk technology and the integration of open source technology with Zendesk products
  • Work with engineering and product teams to recognize and document innovation to expand patent portfolio and manage and promote programs to incentivize patent applications throughout organization
  • Hands on ability to prosecute US and foreign patent applications and manage patent docket
  • Develop Zendesk's strategy for and prosecute a worldwide trademark program for key marks and brand images
  • Closely manage worldwide trademark enforcement efforts
  • Manage and oversee brand usage policies
  • Manage DMCA takedown and trademark infringement policies and procedures
  • Assist in the negotiation and execution of key licenses to technologies incorporated in Zendesk products and utilized internally to support key functions


Represent IP Function with Partnering Legal Team Members
  • Perform due diligence for strategic transactions and public disclosure matters related to IP matters
  • Work with commercial team to optimize IP provisions of customer facing and vendor contracts


What you bring to the role:
  • J.D. or equivalent from a leading program with strong academic credentials
  • Admission in good standing to practice in the state of California and with a minimum of 7 years experience at a leading law firm or a mix of a leading law firm and in-house at a technology company
  • Extensive litigation experience with a focus on intellectual property
  • Prior experience with responses to legal orders and developing related policies
  • Expertise in the incorporation of open source technologies and strategic open source licensing
  • An in-depth understanding of patent law and prosecution strategies
  • A working knowledge of trademark law, prosecution strategies and enforcement programs
  • Ability to negotiate and think creatively and effectively balancing legal constraints with business goals
  • Excellent decision-making skills with a knack for identifying, prioritizing, and articulating the highest impact initiatives
  • Ability to meet deliverables and drive your work to completion within specified timelines
  • Extraordinary communication skills both written and verbal, with a strong attention to detail
  • Natural curiosity, technical savvy, and a real passion for working in a customer focused company where business, technology and law intersect
  • Ability to work and build relationships across functions and provide clear explanations to members of other teams, including senior management
  • Mentality that no task is too big or too small and a willingness to work together towards solutions with integrity, diplomacy, and tact
