JOB SUMMARY


Welltower has an immediate career opportunity for an experienced Construction Attorney and can be located in either our New York, NY, Toledo, OH, or Dallas, TX office. This position is responsible for supporting Welltower’s Investments and Development teams on real estate transactions and construction related matters. This role will also have responsibility for supporting the Risk Management team and overseeing construction-related insurance placements. Must be highly motivated and can work both independently and as part of a larger team in a fast-paced environment.


KEY RESPONSIBILITIES



  • Draft and negotiate design and construction agreements including insurance provisions.

  • Negotiate subcontract revisions and manage relationships with subcontractor legal contacts.

  • Review construction-related financing agreements and create a template to establish a consistent approach.

  • Manage construction and architecture licensing requirements.

  • Advise on subcontractor default issues and draft default letters.

  • Manage construction-related litigation, lien-related issues, and liability claims.

  • Document and track construction-related obligations (required delivery dates, MBE participation requirements, etc.).

  • Draft force majeure and delay notifications.

  • Manage the placement of insurance programs for construction projects including general liability and builder’s risk.

TRAVEL


Some out-of-area and overnight travel may be expected.


MINIMUM REQUIREMENTS



  • Juris Doctorate from an accredited law school with outstanding academic performance demonstrated. 

  • 5+ years of construction-related legal experience and knowledge of insurance concepts and placement

  • Admission in good standing to the Bar and licensed in the state in which you work.

  • Must have strong interpersonal skills, ability to work with clients, the public, and individuals at all levels of the organization in a positive and collaborative manner.

  • Proficient in Microsoft office suite
