Overview:


We are recruiting a talented and experienced medical technology legal counsel to provide and lead strategic and tactical legal initiatives in collaboration with the Chief Legal Officer. The Associate General Counsel will serve as Sight Sciences’ global promotional attorney and privacy counsel will assist with providing legal advice on commercial and other contracts, and will partner with Sight Sciences’ Compliance Department to address compliance and regulatory matters.


 


Responsibilities:



  • Act as subject matter expert, applies deep legal expertise and practices superior working knowledge

  • Serve as a strategic partner to the Compliance Department, thereby advising and supporting implementation strategies to support the business.  Assist the Vice President of Global Compliance with compliance initiatives, and coordinate with the Compliance Department on privacy, data protection, healthcare compliance and other areas of mutual interest

  • Advise and collaborate with Commercial and other business units to ensure that company business activities are conducted in compliance with applicable healthcare laws, regulations and guidance

  • As a core member of the Company’s promotional review committee (PRC), review all advertising and promotional content, and liaise with Commercial, Regulatory and Clinical functions to drive internal training and awareness of laws, regulations, industry guidance and Company policies/procedures pertaining to advertising and promotional content (including adherence to laws and regulations in international jurisdictions in which the Company conducts business)

  • Advise and support Sight Sciences’ Compliance Department in the handling of trade compliance activities and ensure that Sight Sciences remains compliant while streamlining processes, reducing costs, and managing risks

  • Provide commercial contracting support, with a focus on sales, clinical trial, distributor, supply and other contracts that implicate and require an understanding of state and federal healthcare laws and regulations

  • Support complex, strategic transactions involving data protection terms, including reviewing and negotiating customer and vendor DPAs, with emphasis on CCPA, state laws, GDPR and new standard contractual clauses

  • Provides counsel to the Compliance Department in regard to investigations of alleged violations of law, policies and procedures, and the Company’s Code of Conduct

  • Draft, revise, implement and train employees and appropriate external parties on legal policies and procedures, including those related to privacy, trade compliance, healthcare compliance, anti-bribery, and similar areas

  • Take on such other legal/compliance matters as may be requested by the Chief Legal Officer

 


Skills/Qualifications:



  • Bachelor’s degree required

  • JD and active member of a state bar

  • A minimum of 5+ years of healthcare compliance experience in roles of increasing responsibility; strong preference for candidates with significant medical device legal and/or compliance experience

  • Strong working knowledge of regulations applicable to Sight Sciences’ business is required, including FDCA, AKS, FCA, HIPAA/GDPR, and other applicable regulations, AdvaMed/MDMA guidelines, MedTech Europe Code, etc.

  • Working knowledge of regulations and guidance pertaining to review of promotional materials strongly preferred

  • International compliance experience preferred

  • Experience advising executive management (required) with respect to healthcare legal and compliance matters

  • Experience with cost-effective management of outside compliance resources

  • Experience building and leading a compliance program and team preferred

  • Must have excellent oral and written communication skills

  • Ability to work independently and collaboratively among cross-functional teams

  • Ability to work efficiently, prioritize workflow, meet deadlines and balance competing priorities

  • Excellent analytical skills

  • Proficient understanding of business sensitivities and confidentiality

  • Domestic and international travel may be required
