Coke Florida's Labor and Employment Counsel will be responsible for working with the Human Resources department in the management and handling of all labor and employment related matters of the company, both with and without assistance of outside counsel. In addition, this attorney will provide general legal support to the HR team (e.g., contracts, investigations, policies, etc.) and will also provide day-to-day commercial legal support to a few additional business teams within the company. This is a great opportunity for a labor and employment attorney who would like a blended role of L&E work and general commercial legal work, to work in close collaboration with the HR team and also with other business teams of the company.
Responsibilities:


  • Directly representing and defending Coke Florida in labor and employment-related matters, including investigating and responding to attorney demand letters, administrative agency matters, government-initiated inquiries and audits, pre-litigation disputes, and mediations and arbitrations.
  • Supervising, managing, and evaluating outside counsel on employment-related matters including arbitration and litigation.
  • Preparing witnesses for depositions, hearings, arbitration, and trials.
  • Engaging in factual investigation, analyzing complex legal and factual issues, conducting legal research, independently developing, recommending, and presenting strategies and approaches on a variety of disputes and other legal matters.
  • Drafting employment-related agreements such as settlement, separation, and non-disclosure agreements.
  • Responding to third-party subpoenas relating to current and former employees.
  • Maintaining knowledge of current and emerging legal developments, trends, and innovations, particularly in the L&E space.
  • Providing practical L&E-related legal advice and counsel to the company's Human Resources professionals and company management. This responsibility includes legal research and oral and written advice on a broad range of employment and labor law issues, e.g., terminations and discipline, reorganizations, reductions in force, leaves of absence and reasonable accommodations, wage and hour considerations, compensation plans, harassment and discrimination investigations and outcomes, and labor union practices.
  • Participating in investigations in close collaboration with HR.
  • Developing and delivering training and development to employees on employment matters.
  • Reviewing and drafting company employment-related policies and manuals and employee communications.
  • Reviewing communications to company associates.
  • Identifying legal risks and opportunities within the labor and employment area and developing appropriate compliance strategies to ensure company-wide compliance with applicable federal, state, and local laws.
  • Drafting, reviewing, and negotiating agreements for the HR team and for other assigned company groups, including supplier agreements, consulting agreements, professional services agreements, business process outsourcing agreements, benefits-related agreements, non-disclosure agreements and a wide variety of other types of commercial agreements.

Skills & Other Requirements:

  • Expertise in labor and employment law.
  • Ability to determine and understand the company's objectives and risk tolerance and to incorporate the information in making legal decisions.
  • Ability to devise legal solutions that reduce financial liability, costs, and negative publicity to acceptable levels, while also balancing other objectives of the company.
  • Ability to conduct and analyze legal research to determine applicable legal principles.
  • Knowledge of and ability to analyze effect of company policies on business activities.
  • Ability to maintain professional demeanor and focus on objectives in confrontational negotiations.
  • Clearly articulate ideas, opinions, and information, in spoken and written form.
  • Autonomy; work effectively with minimum supervision and recognize when to elevate certain matters to the attention of the Senior Vice President, General Counsel.
  • Ability to adjust priorities in response to unanticipated events.
  • Close attention to detail.
  • Ability to handle confidential and sensitive issues with maturity and professionalism.
  • Friendly, upbeat, with a great attitude and willingness to learn.
  • Excellent time management and organizational skills.
  • Excellent interpersonal skills and the ability to work effectively with employees at all levels.
  • Ability to travel as required (generally less than 10% of the time).

Experience and Education:

  • Juris Doctor degree from an accredited law school.
  • Admitted to the Florida bar and in good standing.
  • 4-7 years of substantive labor and employment experience, including employment defense litigation (including initial case assessment, strategy development, written and spoken communications with opposing counsel, mediators, arbitrators, and representatives of administrative agencies, drafting motions, position statements, mediation statements and communications with administrative agencies, and representing the company at mediations and arbitrations, ) and counseling clients on a wide range of labor and employment matters.
  • Prior in-house experience a plus.
  • Experience directly handling labor and employment matters before federal and state courts and administrative agencies and conducting employee mediations and arbitrations (not solely through the management of outside counsel).
